Notary in Badung, Bali Files Judicial Review of Attorney General's Office Law

bali.jpnn.com, DENPASAR - Hartono, a notary in Badung, Bali, decided to file a Judicial Review (JR) of the Indonesian Attorney General's Office Law with the Constitutional Court (MK). Singgih Tomi Gumilang, Hartono's legal representative, filed the JR of the Indonesian Attorney General's Office Law on Wednesday (8/2). “The complete application file was received by Mrs. Nurul Quraini with receipt number: 15-1/PUU/PAN.MK/AP3,” said Singgih Tomi Gumilang to the media.

According to Singgih Tomi Gumilang, the judicial review of the Indonesian Attorney General's Office Law was initiated after the Gianyar Public Prosecutor filed a case review on December 26, 2022, with cover letter number: TAR-3385/N.1.15/Eku.2/12/2022 signed by Gianyar District Attorney Ni Wayan Sinaryati. “Therefore, our client requests the Constitutional Court judges to review Article 30C Letter h and the Explanation of Article 30C Letter h of the Indonesian Attorney General's Office Law,” he said. Article 30C letter h and the Explanation of Article 30C letter h of the Indonesian Attorney General's Office Law stipulate the duties and authorities of the Public Prosecutor (JPU) to file for a case review (PK).

This regulation was used as the legal basis by the Gianyar District Attorney's Office (Kejari) to file a PK on December 26, 2022, for its client's case. In fact, the extraordinary legal remedy of PK is based on the philosophy of restoring the rights and justice of a person who believes that they have been treated unfairly by the state based on a judge's decision.
